Terms and Conditions

These Terms and Conditions govern orders for goods placed through the ÖEHV Shop. Mandatory statutory consumer rights remain fully unaffected.

1. Scope and contracting party

These Terms and Conditions apply to orders in the online shop of the Austrian Ice Hockey Association (ÖEHV), Attemsgasse 7/D, 1st floor, 1220 Vienna, Austria, association register number 288035099 (referred to below as “ÖEHV” or “we”).

A consumer is any natural person who does not conclude the transaction for the operation of a business. A business customer is a person for whom the transaction forms part of operating a business. Customer terms apply only where we have expressly accepted them.

2. Products and availability

Products displayed in the shop do not constitute a legally binding offer; they invite you to place an order. Product images may differ slightly from the actual product depending on the screen used.

Offers are valid while stocks last. If an ordered product is unavailable, we will inform you without undue delay. Payments already received for goods that cannot be delivered will be refunded without undue delay.

3. Ordering and conclusion of the contract

You can select products, place them in your cart, and review and correct your information in the Shopify checkout before placing the order. By activating the button clearly marked as creating an obligation to pay, you submit a binding offer to purchase the goods in your cart.

The automatic receipt notice confirms that we have received the order but does not yet accept it. The purchase contract is concluded when we expressly accept the order, issue the invoice, or dispatch the goods. Before placing the order, you can access, save and print the applicable Terms and Conditions from this website.

4. Prices, shipping costs and taxes

All product prices are gross prices in euros and include applicable VAT. Any additional shipping costs for the selected delivery address are shown separately at checkout before you place an order with an obligation to pay.

Deliveries outside the European Union may incur import taxes, customs duties or comparable charges. These are levied by the relevant authorities and must be paid by the recipient unless checkout states otherwise.

5. Delivery

Delivery areas, available shipping methods, costs and the expected delivery period for the specific order are shown at checkout. We ship only to delivery addresses that can be selected and entered completely there.

If delivery fails because an address was incorrect or incomplete, or because the shipment was not accepted, we may charge the additional shipping costs actually incurred where the customer is responsible for the cause.

6. Payment

Available payment methods are shown at checkout. Payments are processed through Shopify and the payment providers selected there. Their terms apply additionally to the extent that they do not conflict with mandatory consumer rights.

Statutory interest and other statutory consequences apply to late payments.

7. Retention of title

The delivered goods remain the property of the ÖEHV until payment has been made in full.

8. Statutory warranty rights

Statutory warranty rules apply, including the Austrian Consumer Warranty Act (VGG) and Consumer Protection Act (KSchG) for consumers. The statutory warranty period for movable goods is generally two years from delivery.

A voluntary guarantee exists only where it is expressly promised for a particular product. A guarantee does not restrict statutory warranty rights.

9. Liability

We are liable under the statutory rules. Mandatory liability, including for personal injury, under product-liability law, and for intent or gross negligence, remains unaffected.

10. Right of withdrawal

Consumers generally have a fourteen-day right of withdrawal from distance contracts. The conditions, periods, consequences, statutory exceptions and model withdrawal form are set out on the “Right of Withdrawal” page. An online withdrawal function is also available there.

11. Returns and complaints

Please package returned goods safely for transport. Advance notice helps us assign a return but is not a condition for exercising statutory rights effectively.

12. Privacy

13. Governing law, jurisdiction and contract language

Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice applies only insofar as it does not restrict mandatory rules of the country of their habitual residence. Statutory jurisdictions apply to consumers; Vienna is agreed as the place of jurisdiction for business customers where legally permitted.

The contract language is German. The English translation is provided for information; where the versions conflict, the German version prevails unless mandatory law provides otherwise.
