Official statement on the decision of the Vienna Commercial Court

Statement by ÖEHV President Klaus Hartmann:

On 08.04.2025, we brought proceedings against Kurier seeking an injunction against certain statements contained in an article published on 1 April 2025. Alongside the action, we applied for the court to issue an interim injunction provisionally prohibiting Kurier from making the statements at issue in the action until a final and binding decision on the claim has been reached. The Vienna Commercial Court dismissed this application in its decision of 30.10.2026. The civil proceedings concerning the action are still pending.

In our view, in this decision the Vienna Commercial Court interprets this article, which contains incorrect statements that are highly detrimental to the Federation, in a downplaying manner. We cannot accept this and will therefore make use of the opportunity to challenge this decision before the Vienna Higher Regional Court.
